CardExchange — Terms & Conditions

1. Introduction & Definitions

Welcome to CardExchange (“we”, “us”, “our” or “CardExchange”). These Terms & Conditions (“Terms”) govern your use of our website cardexchange.in and related services (the “Platform”). By using the Platform, you agree to be bound by these Terms.

  • Seller — a user listing a gift card for sale on the Platform.
  • Buyer — a user purchasing a listed gift card.
  • Verified — a listing that has passed manual or automated verification by CardExchange.
  • Unverified — a listing awaiting verification; shown with limited details.

2. Eligibility & Account

You must be 18 years or older and legally capable of entering into binding contracts in India. You agree to provide accurate and complete information while creating your account and keep it updated.

3. Listing & Verification Policy

a) Sellers can list gift cards using the official submission form. Providing correct card number, PIN, and screenshot is mandatory for verification.
b) CardExchange may use automated or manual methods to verify card validity, balance, and expiry. Verification indicates “checked and active” status at the time of verification — CardExchange is not liable if the card balance later changes or becomes invalid.
c) Only verified cards are eligible for direct sale checkout. Unverified cards appear in the contact-based “Unverified” section.

4. Fees, Commissions & Charges

Important — Fee Summary:

  • Listing Fee: No listing fee currently.
  • Platform Commission: CardExchange charges a fixed 10% (ten percent) commission on the final sale value of every Verified transaction. This amount is automatically deducted before Seller payout.
  • Processing & Gateway Fee: 2% additional fee applies for payment processing and bank settlement costs.
  • Payout Fee: ₹10 + 1% of the payout amount per withdrawal (instant payout option may incur extra 2.5%).
  • Chargeback/Dispute Recovery: In case of chargebacks or false claims, CardExchange may deduct up to ₹500 or actual costs incurred from Seller balance.

Example: On a ₹2000 sale → Commission ₹200 (10%) + Processing ₹40 (2%) = ₹240 total deductions. Seller payout before withdrawal fees ≈ ₹1760.

5. Taxes

All applicable taxes (GST, TDS, etc.) are the Seller’s responsibility. CardExchange may collect and remit taxes where legally required. Sellers are responsible for reporting their own income.

6. Payment & Payouts

a) Verified Sales: Payment is collected by CardExchange and released to Seller after deducting commission & fees, usually within 2–5 business days.
b) Unverified Sales: These are peer-to-peer deals. CardExchange is not responsible for payment issues or disputes in such cases.
c) CardExchange reserves the right to hold or delay payouts for compliance checks or fraud reviews.

7. Refunds, Returns & Disputes

a) Refunds apply only to Verified cards sold through the platform checkout system. Buyers must report issues within 24 hours of purchase.
b) Unverified or off-platform transactions are not covered by CardExchange refund policy.
c) If fraud, misuse, or false listings are detected, Seller payouts will be blocked, and the account may face permanent suspension.

8. Seller & Buyer Responsibilities

  • Seller must ensure the card is valid, active, and unredeemed before listing.
  • Buyer must verify all details before purchasing.
  • Any attempt to scam or mislead will result in permanent ban and legal action.

9. Prohibited Activities

  • Selling expired, used, or stolen gift cards.
  • Listing unauthorized or restricted brand cards.
  • Engaging in multiple fake listings, self-buying, or price manipulation.

10. Privacy & Security

We collect and process your personal data in accordance with our Privacy Policy. Sensitive data like card PINs are stored securely and never shared publicly. Users are advised not to post full card details in any public section.

11. Limitation of Liability

CardExchange is a listing and verification platform — not the original issuer of any gift card. We do not guarantee brand acceptance or long-term validity. Our liability is limited to the commission amount earned from the disputed transaction.

12. Suspension & Termination

We may suspend or terminate any account found violating policies, engaging in fraud, or using fake information. Pending payouts may be held during investigation.

13. Updates & Modifications

CardExchange reserves the right to modify fees, terms, and policies at any time. Continued use after updates means acceptance of new terms.

14. Governing Law

These Terms are governed by Indian law. Disputes shall be handled under the jurisdiction of courts in Mumbai, India.
